The domain name www.pursueit.ae (hereinafter referred to as "Website") and/or the Pursueit mobile applications, jointly referred to as "Platform" is owned by Pursueit FZ LLC (hereinafter referred to as "Pursueit" or "Company"). We are committed to protecting your personal data in compliance with the UAE Federal Decree-Law No. 45 of 2021 regarding the Protection of Personal Data (PDPL). This Privacy Policy explains how we collect, use, protect, and transfer your information, as well as your legal rights regarding your personal data. By explicitly accepting this policy, registering for a user account, or booking classes, you agree to the practices described herein.

This Privacy Policy is a part of and incorporated within, and is to be read along with, the Terms of Use.

1. Identity of the Data Controller

Pursueit FZ LLC is the Data Controller of your personal data, as defined under the UAE Federal Decree-Law No. 45 of 2021 regarding the Protection of Personal Data ("PDPL"). The Company is incorporated in the UAE and operates the Platform.

2. Collection of Information

You may give us personally identifiable information about yourself by filling in forms on the Platform or by corresponding with us by phone, e-mail or otherwise. Personally identifiable information may include information you provide when you register to use the Platform, subscribe to our Services, participate in social media events on the Platform, provide feedback, reviews and rating or when you report a problem with the Platform. The information you give us may include your name, address, e-mail address, phone number, personal description, photographs, family details, date of birth of self and family members, payment and billing information (processed via PCI-DSS compliant third-party processors — we do not store raw card numbers), etc. You may also choose to provide other personal information such as your preferred location, interest preferences, and children's school information.

We may share personal information with third parties, including but not limited to payment providers, service partners or third-party suppliers, in order to facilitate the processing and fulfilment of your orders, improve our Service, comply with laws, protect our rights and property, or in connection with any merger, acquisition, or sale of all or a portion of our business or assets.

With regard to each of your visits to the Platform, we may automatically collect the following information:

Technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform.
Information about your visit, including the full URL click stream to, through and from the Platform (including date and time); material or information that you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

We may enable you to log onto the Site or Services using a social networking site account, such as Google or Facebook. If you choose to log on or otherwise link the Service with your social networking account, we may receive Personal Information from that social networking site in accordance with their privacy policies.

We are also working closely with third parties (including business partners, payment services, advertising networks, analytics providers, search information providers, and credit reference agencies) and may receive information about you from such sources.

Cross-Border Data Transfers

In providing our services, we may share your data with third-party service providers located outside the UAE (such as payment processors, cloud hosting partners, and analytics providers). We ensure that any international data transfers comply with the UAE PDPL by implementing appropriate legal safeguards, by using standard contractual clauses approved under UAE law, or by obtaining your explicit prior consent after informing you of the possible risks.

3. Legal Basis for Processing Your Personal Data

Under the UAE PDPL, every processing activity must rest on a lawful basis. We rely on the following:

Contractual Necessity

To process your class bookings, manage your account, facilitate payments, and provide our core services.

Explicit Consent

For sending promotional materials, newsletters, and processing precise location data. You may withdraw this consent at any time without affecting the lawfulness of prior processing.

Legal Obligation

To comply with UAE regulatory, law enforcement, accounting, and tax requirements.

Legitimate Interests

To improve our platform, ensure security, and detect fraud, provided these interests do not override your fundamental rights.

4. Use of Information

We may disclose your personal information to any of our employees, officers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this privacy policy.

The information available with us may be used as follows:

To carry out our obligations arising from any contracts entered into between you and us.
To verify and process your personal particulars and payment.
To communicate with you, including to confirm and update you on the status of the Services and respond to your queries and requests.
To share with Partners solely for the purpose of fulfilling your specific service booking, in accordance with their Partner Agreement with Pursueit. Partners are not permitted to use your data for independent marketing, promotional communications, or any purpose beyond booking fulfilment.
To inform you of promotions, offers, surveys, events, products and services which may be of interest to you, where you have given your consent.
To facilitate the Services offered through the Platform.
To update and back-up our records.
To detect and protect us against error, fraud and other criminal activity.
To comply with Applicable Law, the requests of law enforcement and regulatory officials, or orders of court.
To enforce our legal rights and remedies.
To enhance the security of the Platform.
To personalise content and remember information to help you efficiently access your account.
To provide you with information about other services we offer that are similar to those that you are already using or have enquired about.
To provide you, or permit selected third parties to provide you, with information about services we feel may interest you. If you are a registered User, we will only contact you by electronic means with information about services similar to the Services. If you are a new customer, and where we permit selected third parties to use your data, we (or they) will contact you by electronic means only if you have consented to this. If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please write to us at support@pursueit.ae.
To notify you about changes to our Services.
To ensure that content from the Platform is presented in the most effective manner for you and for your device.
To send you Service-related notices. We may also use your contact information to send you marketing email messages where you have opted in. If you do not want to receive such messages, you may opt out by following the instructions in the message.
To administer the Platform and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes.
To improve the Platform to ensure that content is presented in the most effective manner for you.
To allow you to participate in interactive features of our Services, if any, when you choose to do so.
To publish in social media or on the Platform for the promotion of the Company or the Platform as part of our efforts to keep the Platform safe and secure.
To measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you.
To make suggestions and recommendations to you and other Users of the Platform about Services that may interest you or them.

We will never sell your personal data to third parties for their own commercial or marketing purposes.

Except as provided in this privacy policy, we will not provide your information to third parties.

5. Location Data

In order to get the most out of our service and to allow us to provide you with tailored offers, we need to process your approximate location from time to time. The types of location data that will be processed are your latitude, longitude, cell tower ID, etc. Precise location data is only processed where you have provided separate, explicit consent.

Your location data will only be processed for as long as necessary in order for us to respond to your request for tailored offers. The location data may be transferred to our merchants for the purpose of providing you with the best offers at that time to match your preferences.

You can choose not to allow us to process your approximate location at the time you connect to the app, or any time after that, by changing the settings on your mobile device.

6. Information Related to Children and Other Individuals

To the extent that you have provided (or will provide) personal data about your family members, spouse, other dependents, you confirm that you have explained to them that their personal data will be provided to, and processed by, us and you represent and warrant that you have obtained their consent to the processing (including disclosure and transfer) of their personal data in accordance with this Privacy Policy.

In respect of children (i.e. individuals under the age of 18) or individuals not legally competent to give consent, you confirm that you are the parent or legal guardian or person who has parental responsibility over them or the person appointed by court to manage their affairs, to consent on their behalf to the processing (including disclosure and transfer) of their personal data in accordance with this Privacy Policy.

We will not knowingly collect personal data directly from children under 13 without verified parental or guardian consent. If we discover that we hold data of a child under 13 collected without such consent, we will delete it promptly.

7. Cookies

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Like many sites, we use cookies to collect information.

We use the following types of cookies:

Strictly necessary cookies: Required for the Platform to function. No consent is needed for these.
Functional cookies: To remember your preferences and settings.
Analytics cookies: To measure how users interact with the Platform (e.g. Google Analytics). These require your consent.
Marketing cookies: To deliver relevant advertising. These require your consent.

8. Security

The security of your Personal Information is important to us. We implement appropriate technical and organisational measures including encryption of data in transit (TLS/SSL) and at rest, access controls limiting data access to authorised personnel only, regular security assessments, staff training on data protection, and PCI-DSS compliant payment processing.

Remember that no method of transmission over the internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the UAE Data Office and, where required, you personally, within the timeframes prescribed by the PDPL.

9. Analytics

We may use analytics services, such as Google Analytics (see http://www.google.com/policies/privacy/partners/ and https://tools.google.com/dlpage/gaoptout) to analyse how our users use the Site and help improve our Site and Services.

10. Data Retention

We retain your personal data only for as long as necessary to fulfil the purposes outlined in this Privacy Policy or to comply with our legal obligations under UAE law. Our standard retention periods are as follows:

Account and booking data: retained for the duration of your account plus 5 years after closure, on the basis of contractual necessity and tax/accounting obligations.
Payment and transaction records: retained for 7 years in accordance with the UAE Commercial Transactions Law and tax obligations.
Marketing consent records: retained until consent is withdrawn, plus 3 years, as evidence of lawful processing.
Customer service communications: retained for 3 years from the last interaction, on the basis of legitimate interests for dispute resolution.
Analytics and usage data: retained for 26 months, anonymised after 13 months, on the basis of legitimate interests for platform improvement.

On expiry of the applicable retention period, your personal data will be securely deleted or irreversibly anonymised.

11. Your Rights Under the UAE PDPL

As a user, you are entitled to specific rights regarding your personal data under the UAE Federal Decree-Law No. 45 of 2021. You have the right to:

Right of Access (Art. 9)

Request a copy of the personal data we hold about you and information about how it is processed.

Right to Correction (Art. 10)

Request that we correct inaccurate or incomplete personal data without undue delay.

Right to Erasure (Art. 11)

Request the deletion of your personal data where it is no longer necessary for the purposes for which it was collected, where you withdraw consent, or where processing is unlawful, subject to our legal retention obligations.

Right to Restriction of Processing (Art. 12)

Request that we restrict processing of your data in certain circumstances, for example while the accuracy of your data is contested.

Right to Object (Art. 13)

Object to our processing of your data based on legitimate interests, including profiling for direct marketing purposes.

Right to Data Portability (Art. 14)

Receive your personal data in a structured, commonly used, machine-readable format and, where technically feasible, request that it be transmitted to another controller.

Right to Withdraw Consent

Where we rely on your consent to process data, you can withdraw it at any time without affecting the lawfulness of prior processing.

Right Not to Be Subject to Automated Decisions

Not to be subject to a decision based solely on automated processing, including profiling, that produces legal or similarly significant effects, without human review.

To exercise any of these rights, please contact us at support@pursueit.ae. We will verify your identity and respond within 30 days of receipt of your request, extendable by a further 30 days for complex cases, with prior notice to you.

12. Automated Decision-Making and Profiling

We may use automated processing to personalise content, recommend activities, and prioritise offers shown to you. Such processing does not produce legal or similarly significant decisions without human review. Where any automated processing could produce a significant effect on you, we will notify you separately and provide you with the right to request human review, express your view, and contest the decision.

13. Personal Data Breach Notification

In the event of a personal data breach, we will:

Contain the breach and assess the risk to affected individuals as quickly as possible.
Notify the UAE Data Office without undue delay and, where feasible, within 72 hours of becoming aware of a breach that poses a risk to your rights or freedoms.
Notify affected data subjects directly and without undue delay where the breach is likely to result in a high risk to their rights or freedoms.
Document all breaches, their effects, and remedial measures taken in our internal breach register.

14. Right to Lodge a Complaint with the UAE Data Office

You have the right to lodge a complaint with the UAE Data Office, the national supervisory authority for data protection, if you believe that our processing of your personal data infringes the UAE PDPL.

15. Third-Party Links and Services

The Platform may contain links to third-party websites, social media platforms, or services that we do not operate. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party sites you visit. We are not responsible for the privacy practices or content of third-party sites.

16. Changes to this Policy

We may amend this Privacy Policy from time to time to reflect changes in our practices, technology, or applicable UAE law. Material changes will be communicated to you by email notification to the address registered on your account and/or a prominent notice on the Platform prior to the change taking effect.

The effective date at the top of this policy reflects when it was last revised. Where changes require fresh consent, such as processing for new purposes, we will seek it before processing your data for those new purposes.
